PRIVACY POLICY

Grover Tech, Inc. and its affiliates (together, "Grover" "We", “US” or “Our”) values its customers (“You”, or “Your”) and respects Your privacy, and wants You to be familiar with how We collect, use and disclose information. This Privacy Policy describes Our practices in connection with information that We collect through Our website operated by or on behalf of Grover, located at www.grover.com (“Site”).


1. UPDATES TO THIS POLICY


We may change this Privacy Policy from time to time. Please take a look at the "Effective Date" legend at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective on the "Effective Date" date indicated above. If We make any material changes to this Policy, We will endeavor to notify You by email or by posting a prominent notice on the Sites prior to the change becoming effective. Your continued use of the Site after the publication of the Privacy Policy is Your agreement to be bound to these changes. If You do not accept the terms of this Privacy Policy, Your only remedy is to discontinue use of the Services.


2. INFORMATION WE COLLECT


We collect Personal Information from a number of sources. You may voluntarily provide this information to Us by submitting it. In some cases, We may collect information about You from other sources, including third parties (including marketing, credit scores, fraud prevent agencies, and financial institutions), those from whom We purchase personal information and from publicly available information, such as information published on social media sites, to the extent permitted by applicable law, and We may combine that information with personal information provided by You. While We obviously collect personal information from You directly, We can also use third party sources of information in order to fulfill the purposes set out in this Privacy Policy.


We collect two types of information: Personal Information and Other Information. "Personal Information" is information that relates to You as an identifiable specific individual. "Other Information" is any information that cannot be tied back to You as a specific individual.


IF YOU SUBMIT ANY PERSONAL INFORMATION RELATING TO ANYONE OTHER THAN YOURSELF, YOU REPRESENT THAT YOU HAVE OBTAINED ANY NECESSARY CONSENT FROM THAT INDIVIDUAL FOR USE AND DISCLOSURE OF THAT INDIVIDUAL’S PERSONAL INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.


3. PERSONAL INFORMATION


3.1 Types.


We and Our service providers collect the following Personal Information:


1. Account Information:


  • Name and customer characteristics;

  • Identity verification data, such as government-issued ID, audio, video or biometric facial identifiers;

  • Physical address (including billing and shipping addresses);

  • Telephone number;

  • Email address;

  • IP address;

  • Device ID;

  • Your city, state or zip code of residence, and date of birth.


2. Billing information and Fraud Prevention:


  • Credit and debit card numbers, as applicable;

  • Credit scores, such as FICO;

  • Social security number;

  • Bank account data, if linked and solely as applicable;

  • Browsing and or search history


3. Form, Email and Chat Data.


  • You may voluntarily submit to Us, and we will retain and process information from online forms and other online communication systems (such as chat support) including email and chat applications. This may include personal information, such as your name, job title, company name, address, phone number, email address;

  • We will maintain a record of Your orders, purchases, exchanges, returns, wish lists and gift registries in connection with the Site or Our business.


4. Third-Party Connection Data


  • If you access our Service through a third-party service, that third party you connected with may pass certain information about your use of its service to Us. The information we receive will depend on the policies and your account settings with the third-party service.

3.2 Use.


Depending on the purpose, We may use various categories of information in order to provide and improve the Services described in the Terms. To that end, We may use Personal Information about You:


  • To respond to Your inquiries and fulfill Your requests, including to contact You if necessary;

  • To process and fulfill Your order, for example by confirming Your order and Your billing and shipping information, processing Your payments, delivering your products and communicating with You regarding Your order;

  • To verify Your identity prior to Your User Account being confirmed;

  • To send to You important information regarding the Site, changes to Our terms, conditions and policies and other administrative information;

  • To send to You information by email, mail, telephone and other means about Our products, services, contests, sweepstakes and other promotions;

  • To administer and fulfill Our contests, sweepstakes and other promotions (please note that certain contests, sweepstakes or other promotions may have additional rules or policies, which could contain different or additional information about how We use and disclose Your personally identifiable information; We suggest that You read any such rules or policies carefully − in the event of a conflict between such rules or policies and this Privacy Policy, such rules or policies will govern);

  • To help Us improve the customer experience, including by learning more about Your preferences to help personalize Your experience with Us;

  • To allow You to send messages to a friend through the Site (please note that, by using such functionality, You are agreeing that You have the right to provide to Us Your friend’s name and email address for such purpose);

  • To analyze trends and statistics in connection with Our businesses and Internet properties, including to measure the success of marketing campaigns and to compile statistics about usage and response rates;

  • To protect the security or integrity of Our businesses and Internet properties; and

  • As We believe to be necessary or appropriate: (a) under applicable law, including laws outside Your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside Your country of residence; (d) to enforce Our terms and conditions; (e) to protect Our operations or those of any of Our Affiliates; (f) to protect Our rights, privacy, safety or property, or that of You, Our Affiliates or others; and (g) to allow us to pursue available remedies or to limit the damages that We may sustain.


3.4 Bank Account Information.


On a customer-by-customer basis, three months of bank account data (including account balances, turnover and transaction data) may be accessed through a third-party provider solely for the purposes of (i) of deciding on the establishment of a contractual relationship, (ii) for identity verification and/or (iii) for fraud prevention.


3.5 Disclosure.


We may disclose Personal Information to service providers, and sometimes third parties, for various purposes, such as:


  • To Our third-party service providers, who provide services such as website hosting, data storage, data analysis, payment processing, order fulfillment, IT services and infrastructure, customer service, email delivery and administration, credit card processing, auditing and other similar services to enable them to provide services;

  • To Our subsidiaries and affiliated entities or for marketing and other purposes;

  • To selected third parties ("Promotional Partners"), to permit them to send to You marketing communications. Grover seeks to select as Promotional Partners only reputable companies that offer what We believe to be high-quality products and services;

  • To third-party sponsors of contests, sweepstakes and similar promotions;

  • To identify You to anyone to whom You send messages through the Site;

  • To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Our business, assets or stock (including in connection with any bankruptcy or similar proceeding); and

3.5 Phone Number.


By providing your phone number, you consent to receiving calls, texts, and similar messages from Grover or its service providers. Standard voice and data rates may apply and Grover is not responsible for any charges to you for these messages. You may opt-out or receiving these messages at any time by replying “STOP” to any text.

4. OTHER INFORMATION WE COLLECT

4.1. "Other Information"


is any information that, without exception, does not identify You as a specific individual, such as:


  • Type of browser used;

  • Server log files;

  • Information collected through cookies, pixel tags and other technologies;

  • Physical location of Your device;

  • Non-personally identifiable information provided by You; and

  • Information that is aggregated by Us derived from Your Use of the Site


4.2. Collection.


We and Our third-party service providers may collect Other Information in a variety of ways, including:


  • Through Your browser: Certain information is collected through most devices, such as Your Media Access Control ("MAC") address, device manufacturer and model, device identifier, screen resolution, and the type and version of Your operating system and browser.

  • Through server log files: An Internet Protocol ("IP") address is a number that is automatically assigned to a device by an Internet Service Provider ("ISP"), and is identified and logged automatically in Our server log files whenever a user visits the Site, along with the time of the visit and the page(s) that Were visited. We and Our service providers use IP addresses for purposes such as calculating usage levels, helping diagnose server problems and administering the Site.

  • Using cookies: Cookies allow a Web server to transfer data to a device for recordkeeping and other purposes. We and Our service providers use cookies and other technologies to, among other things, enhance and personalize Your online browsing and shopping experience and facilitate Your ongoing access to and use of the Site, as Well as for online tracking purposes. Such services use cookies and similar technologies to analyze how visitors use the Site, to compile statistical reports on activity related to the Site, and to provide other services related to the Site. Such services may also collect information about visitors’ use of other Websites or other online resources. This may include: pages visited within the Sites, referring/exit pages, search terms, operating system, date/time stamp, and clickstream data.   • Using pixel tags and other similar technologies: Pixel tags (also known as Web beacons and clear GIFs) are small images that may be used by Us and Our service providers in connection with some pages of the Site and HTML-formatted email messages to, among other things, render such pages to You on various hardware devices and operating system versions, track the actions of Users and email recipients, measure the success of marketing campaigns and compile statistics about usage and response rates. Pixel tags may collect information such as the pages, features and links accessed by a user, and the IP address, browser type and operating system of such user’s device.

  • Physical location: We and Our service providers may collect the physical location of Your device by, for example, using satellite, cell phone tower or WiFi signals. We may use Your device’s physical location to provide You with personalized location-based services and content, including for marketing purposes, based on the choices that have been made with respect to such uses. We may also share Your device’s physical location, combined with information about what advertisements You viewed and other information We collect, with Our third-party marketing partners, such as Our Promotional Partners, to enable them to provide You with more personalized content and to study the effectiveness of advertising campaigns, based on the choices that have been made with respect to such disclosures. In some instances, You may be permitted to allow or deny such uses and/or sharing of Your device’s location, but if You choose to deny such uses and/or sharing, We, Our service providers, and/or Our third-party marketing partners may not be able to provide You with the applicable personalized services and content.

  • By aggregating information: We and Our service providers may aggregate Personal Information collected from Our customers and potential customers, for example by using Personal Information to calculate the percentage of such individuals who have a particular telephone area code. Aggregated Personal Information does not personally identify You or any other customer or potential customer.


4.3 Use of Other Information.


We may use and disclose Other Information for any purpose. In some instances, We may combine Other Information with Personal Information (such as combining Your zip code with Your name). If We combine any Other Information with Personal Information, the combined information will be treated by Us as Personal Information while it is so combined.



5. RETENTION


Grover will retain your personal information for a period of time in order to effectuate the original purpose of collection, or as required by law. Following this period, We will delete the personal information collected.


Our data retention policies are as follows:


  • Logfiles are deleted in principle after the end of the respective browser session, at the latest after seven days, unless their further storage is exceptionally necessary and lawful. The storage period of cookies depends on the individual case and is usually between twelve and 24 months.

  • User data, your User Account, and fraud detection data will be deleted five years after the end of Your last rental contract or after Your last login, whichever comes later.

  • Data on or from telephone conversations will be deleted one year after the last telephone conversation with the customer; recordings are automatically deleted after 30 days.

  • Data relating to credit scoring for rejected potential Users is deleted or anonymize after six months. For approved Users, it is deleted or anonymize five years after the end of your last rental agreement or after your last login, whichever comes later.

  • Bank account information and biometric data is deleted and/or anonymized six months after receipt of the information.


6. THIRD PARTIES AND THIRD-PARTY SITES.


The Service contains links to websites and applications other than the Service, including websites and applications operated by affiliates and other third parties. To the extent that You submit any Personal Information to any third party (for example, Third-Party Content) Your browsing and interaction on any third-party website or service, including those that have a link on Our Site, are subject to that third party’s terms and conditions and privacy policies. We recommend that You familiarize Yourself with the privacy policies and practices of any such third parties. WE ARE NOT RESPONSIBLE FOR THE INFORMATION COLLECTION, USAGE, DISCLOSURE OR OTHER PRIVACY PRACTICES OF ANY THIRD PARTIES, OURTHIRD-PARTY SERVICE PROVIDERS, OR ANY THIRD-PARTY SOCIAL MEDIA PLATFORM (SUCH AS FACEBOOK INC.). THE INCLUSION OF A LINK ON THE SITE DOES NOT IMPLY ENDORSEMENT OF THE LINKED SITE BY US OR BY OUR AFFILIATES.


7. THIRD PARTIES ADVERTISERS. 

We use third-party advertising companies to serve ads when You navigate the internet. Please note that these companies may use information about Your visit to the Site to provide advertisements about goods and services that may be of interest to You. In the course of serving advertisements to the Site, these companies may place or recognize a unique cookie on Your browser. 8. SECURITY.


8.1 Acknowledgment.


We seek to protect personal information using appropriate technical and organizational measures based on the type of personal information and applicable processing activity. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to us may not be secure. Therefore, you should take special care in deciding what information you send to us via e-mail.


8.2 Security.


We use reasonable organizational, technical and administrative measures to protect Personal Information under Our control. For example, We use Secure Sockets Layer ("SSL") technology for the placement of orders. Unfortunately, no data storage system or data transmission over the Internet can be guaranteed to be 100% secure. Please also be aware that We may use third-party cloud service providers that provide hosting, data storage and other services pursuant to standard terms and conditions that may be non-negotiable; these service providers have informed Us or the general public that they apply security measures they consider adequate for the protection of information within their system. If Grover becomes aware of and determines that an incident involving personal information qualifies as a breach of security leading to the misappropriation, accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal information that compromises the security, confidentiality or integrity of such personal information, Grover will report the breach within 72 hours of the confirmation.


8.3 Do Not Track.


Please note that the Site will continue to operate as described in this Privacy Policy, whether or not a "Do Not Track" signal or similar mechanism is received from Your browser. If we do so in the future, we will describe how we do so in this Privacy Policy.


9. STATE LAW RIGHTS REGARDING OUR USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION.


Some state laws, including those in California, New York, Texas, Washington, Illinois or Virginia, provide residents of the applicable state a number of rights as they relate to Personal Information. These are the “right to know”, the “right to delete”, and the “right to opt-out”.


9.1 Right to Know.


You may request Grover provide You the specific pieces of personal information that Grover has about You; categories of personal information We have collected about You; categories of sources from which the personal information is collected; categories of personal information that Grover sold or disclosed for a business purpose about You; categories of third parties to whom the personal information was sold or disclosed for a business purpose; and the business or commercial purpose for collecting or selling personal information. Please note that much of the information You can make a request for is already contained in this Policy. Should You wish to exercise this right, please see the section below which explains how to do so. If You do not have a User Account with Grover, We may ask for some Personal Information in order to verify Your identity and Your rights to the data subject to your request.


9.2 Right to Delete.


Some state law gives residents a limited right to request deletion of their Personal Information. However, this right is limited by a number of exceptions and We generally do not accept requests to delete Personal Information. We will, however, respond to requests to remove Personal Information from some of Our systems as a part of a request to close or otherwise disable a membership account. If You would like to request deletion of Personal Information, please see the section below which explains how to do so. If You do not have a User Account with Grover, We may ask for some Personal Information in order to verify Your identity and Your rights to the data subject to Your request.


9.3 Right to Opt-Out.


Grover does share Personal Information with third parties for cross-contextual behavioral marketing purposes, and We permit Our marketing partners to collect data directly from You. You may choose to opt-out of the sharing of Your Personal Information with third parties for marketing purposes at any time by submitting a request in writing to the “Contact Us” address below. Additionally, You may use the opt-out mechanism noted above in the “Third Party Advertisers” section. Please note that this opt-out does not prohibit disclosure made for non-marketing purposes. Requesting to op-out of some essential Uses may result in Your inability to Use the Grover Services. All opt-outs are effective going forward only.


9.4 Exercising Your privacy rights.
